Need some help

Postby Coote_00 » Fri Jun 14, 2019 2:10 pm

Hey all I just want some advice on what i should do here
I sent my car to NitroDann over 6 months ago for a rebuild and a tune. Have hardly heard back from him now it’s been over a month since I’ve heard anything. Any suggestions on what to do and where to go from here
Cheers

Call, email, facebook. Hit him on every communication channel you can. When he's busy he's often slow to respond, but he's been quieter than normal lately.

I have tried all those avenues and still nothing it’s getting a bit beyond a joke now and yes I realise he can get busy but having to have waited this long with very little response is ridiculous

I would be concerned about not seeing your car again. Time to hire a trailer and go collect your car. I would not delay it a day longer.
Also seek legal advice - this has become one of those mechanic disputes.

Well that’s basically where I’m at but supposedly it’s at his house not his workshop because he had to sh*t it down

Legal advice. This has become a mess.

Yeah, that's a bit of a mess. Take Bruce's advice, I think you've been reasonable with patience and effort to contact.

Any forum member's local to Newcastle who could maybe check in on Dann, maybe retrieve the car for short term keeping? I don't mean that in any kinda bad or threatening way, he's part of our community and I've always had good dealings with him.

The simple solution; ask Dann nicely to give back the car with an invoice of what is owed (pay him on the spot, don't quibble). Everybody's mildly happy, you have the car back.
The tough solution; ask Dann via a solicitor, let the battle begin.
It's quite a common occurrence (goggle it).

That’s the other issue it was paid for in full so no money is owed only what he needs to do with the car

I have no reason to want to turn this ugly I just want what was ment to be done to car sorted but now it’s at the point I’ll just be happy to get the car back but I don’t know where he lives so I can’t even go retrieve it

That was silly paying him upfront. Be prepared to get the car back (IF it still exists) with no work done and some damage on it. No use suing him for a refund as I will assume he has no assets.

Yeah everyone I’ve spoken to about the situation has said that was a dumb move paying him but didn’t think he was going to screw me over either. And as far as I’m aware he has assets he owns race cars right? Like I’m saying I’m happy to just have the car returned at this point

Assume he has nothing. If he can't pay the rent for his workshop (which would not be expensive as it is Newcastle not Sydney/Melb) I'd assume the worst (it all points in that direction).

Plus, discussing on the forum won't help the situation. At this stage I doubt Dann would suddenly feel guilty and just return the car. By discussing here also telegraphs to him what you are going to do, which may reduce your chances of getting the car back.
This only allows you to vent, which may be detrimental to the situation.

If you need help then the right process should be taken. Posting comments and others giving advice here is not the right way. There are free claims tribunals probably in every State who will address consumer complaints and of course legal firms who will give advice and take action if warranted- but at a cost. In reality this is not "our" business.
